In short
Effective
Use Dmand AI to reach healthcare professionals and organizations in their business roles: selling, marketing, recruiting and research. Do not use it to reach patients or consumers, to decide whether someone gets a job, credit, insurance or housing, or to resell or rebuild our data. Every email and call you send must follow the CAN-SPAM Act, the Telephone Consumer Protection Act and the other laws that apply, and must honor opt-outs.
Key takeaways
- Business-to-business use only
- No eligibility decisions about people
- Honor every opt-out and do-not-call request
- No patient data anywhere on the Platform
1. Who this policy applies to
This policy applies to every customer of Dmand AI and every person who uses the Platform under a customer account, including through the API and our connectors for AI assistants. It is part of the Terms of Service, and the words it capitalizes, such as Platform, Profile Data and Customer Data, mean what the Terms say. Customers are responsible for their Users following it.
2. What you can use Dmand AI for
Dmand AI is built for teams that sell to, market to or recruit from US healthcare organizations. Contact people about their work, at their work.
- Finding and contacting healthcare professionals, executives and organizations about products and services for their organization or practice.
- Recruiting: telling healthcare professionals about job openings and contracts.
- Account planning, territory planning, market sizing and research about healthcare organizations and their org hierarchies.
- Keeping your CRM accurate and complete for the accounts and contacts you work with.
3. What you cannot do with Profile Data
Do not use Profile Data, enrichment results or anything derived from them:
- For decisions about people. To decide anyone’s eligibility for employment, credit, insurance, housing, a license or a government benefit, or for any other purpose covered by the Fair Credit Reporting Act. Recruiting outreach is allowed; screening, vetting or background checks are not.
- To reach consumers or patients. For consumer marketing, to contact people about their own health or care, or to combine Profile Data with health or claims-related information to identify, profile or target patients.
- To track or harm people. To locate, follow, harass, threaten or intimidate anyone, to contact a person at home, or to discriminate against anyone on the basis of a protected characteristic.
- To resell or rebuild the database. To sell, share or publish it, to offer it in a list or data service, or to build, enrich or train a database or AI model that is offered to others or competes with Dmand AI.
- Beyond your plan. To export more than your plan allows, or to copy data by scraping, automated queries or shared logins.
When a person opts out or asks to be removed through our Privacy Center and we tell you, stop using their Profile Data and delete the copies you got from us, as the Terms of Service describe.
4. Rules for email outreach
You are the sender of every email, so these rules are yours to follow. They apply to connected mailboxes and managed mailboxes alike.
- Follow the CAN-SPAM Act and every other law that applies to commercial email.
- Use accurate sender names, from addresses and reply-to addresses, and subject lines that match the message.
- Include your physical postal address and a clear way to opt out in every commercial email, and keep the opt-out working for at least 30 days after you send.
- Honor opt-outs within 10 business days, and never email a person again after they opt out, from any mailbox or sequence. Do not sell or share the addresses of people who opted out.
- Send only from mailboxes and domains you control or have permission to use. Do not spoof, hide or rotate identities to get around filters or a recipient’s block.
- Do not send to purchased or rented lists of personal email addresses for consumer marketing, and do not keep sending to addresses that bounce.
- Keep complaints and bounces within the limits that Google, Microsoft and other mailbox providers publish, and follow their sender rules.
5. Rules for calls
- Follow the Telephone Consumer Protection Act, the Telemarketing Sales Rule, the Do Not Call rules and state telemarketing laws.
- Do not use an artificial or prerecorded voice when you call a mobile number, unless you have the consent the law requires.
- Check the National Do Not Call Registry and your own do-not-call list where the law requires it, and honor every request not to be called.
- Call only during the hours the law allows in the recipient’s time zone.
- Show a caller ID number that you own and that can be called back. Do not spoof caller ID.
- If you record calls, tell the people on the call and get every consent the law requires. Some states require the consent of everyone on the call.
6. Rules for LinkedIn tasks
LinkedIn steps in a sequence are manual tasks that your Users carry out in their own LinkedIn accounts. Follow the LinkedIn User Agreement. Do not use the Platform together with tools that automate LinkedIn actions, scrape LinkedIn or run accounts that are not your own.
7. What your messages and content must not contain
- False or misleading claims, including claims about your products, your identity, or a relationship with a health system, payer, government agency or the recipient that does not exist.
- Phishing, malware, links to harmful sites, or requests for passwords, payment details or other credentials.
- Content that is unlawful, defamatory, harassing, hateful, sexually explicit or threatening, or that infringes someone else’s intellectual property.
- Promotion of a drug, device or other regulated product that does not follow the rules that apply to it, such as FDA promotion rules, or offers that break the federal Anti-Kickback Statute or similar state laws.
8. Using AI Features responsibly
- Review AI research and AI-drafted emails before you rely on them or send them. You are responsible for what you send.
- Do not use AI Features to impersonate a real person, to write content you know is false about a person, or to make decisions with legal or similarly significant effects on anyone.
- Do not try to make AI Features reveal other customers’ data, our system instructions or anything you are not allowed to see.
9. Data you must not upload or sync
Dmand AI is not built to hold protected health information and does not sign business associate agreements. Do not upload, sync, send or record through the Platform:
- patient data or any other protected health information under HIPAA;
- Social Security numbers, driver’s license or passport numbers, or other government identification numbers;
- financial account, card or payment numbers;
- information about children under 13, or other sensitive personal information as state privacy laws define it.
10. Keeping the Platform secure
- Do not share logins, sell or transfer access, or let anyone outside your organization use your account.
- Do not get around plan limits, Credit charges, sending limits or security controls.
- Do not scrape the Platform or access it with bots, scripts or crawlers, except through the API within its rate limits.
- Do not probe, scan or test the Platform for vulnerabilities, overload it, or interfere with other customers. If you find a security problem, tell us at hello@dmand.ai and do not use it.
- Do not copy, reverse engineer or build a competing product from the Platform.
11. How we enforce this policy
We watch account activity, exports and sending metrics such as bounces, complaints and opt-outs to protect the people you contact, mailbox providers and other customers. Our staff look at specific messages only where needed to investigate a security problem or abuse, with a User’s agreement, or where the law requires it.
If we believe this policy has been broken, we may warn you, pause a sequence, a mailbox or an API key, limit exports, suspend a User or the account, or end the Agreement, as the Terms of Service describe. Where we can, we tell you first and give you the chance to fix the problem. We may report unlawful activity to the authorities and cooperate with them.
12. Report misuse
If you received an email or call through Dmand AI that you think breaks this policy, write to hello@dmand.ai with the sender’s name, the date and, if you have it, the message. We will look into it and take action against the customer where it is warranted. The customer that contacted you remains responsible for its own outreach. To stop all use of your profile by our customers, opt out on Your Privacy Choices or ask us to remove your information.
13. Changes to this policy
We may update this policy as laws, mailbox provider rules and the Platform change. We post the new version here with a new effective date and, for a material change, email account owners at least 30 days before it takes effect.
